Draft bill to ensure responsible use of AI

The Danish government has presented a new draft bill to determine who will monitor and enforce the rules of the EU AI Act. If passed, the rules will enter into force on 2 August 2025.

Last year, the EU adopted a new regulation governing the use of AI (the EU AI Act). We have previously written about that here.

If the draft bill is passed, the Danish Agency for Digital Government, the Data Protection Agency, and the Court Administration will be responsible for monitoring the prohibited use of AI by being able to:

  • Demand and collect all relevant and technical information about AI systems
  • Conduct on-site inspections and technical investigations of AI systems
  • Issue injunctions and temporary bans on the sale, marketing, and use of prohibited AI systems
  • Issue fines

The authorities can also make their decisions regarding the illegal use of AI public.

IUNO’s opinion

This draft bill is part of the broader European regulation of AI and, as something new, implements how the AI rules will be enforced in Denmark. Therefore, companies will need to be prepared to document their use of AI and be able to demonstrate how systems work if the authorities conduct supervisory visits.

IUNO recommends that companies map their use of AI now and assess which risk group their AI systems fall under. Companies should also be prepared to explain how their AI makes decisions and what data it uses. In addition to the new rules, AI systems must still comply with the general rules on, for example, discrimination and data protection.
